Integrative Nurse Coach® Academy Policies, Terms, and Conditions
Effective November 24, 2025.
By registering for any Integrative Nurse Coach® Academy (“INCA”) course, program, event, or product, you agree to the following policies and terms.

At-a-Glance Course Policies
- Respectful Conduct: Professional behavior is required. INCA may remove learners for inappropriate conduct without refund.
- Intellectual Property: Materials are for personal use only and may not be shared or used outside the course without written permission.
- Payment Plans: Payments must remain current; plans continue even if a student defers or re-enrolls. Certificates require full payment.
- Refunds: Under $100 non-refundable. INCCP refunds only within 48 hours if 30+ days before start and no materials accessed. Specialty refunds only within 1 business day if no materials accessed. All approved refunds have a 6% processing fee.
- Deferrals (INCCP only): One-time deferral allowed. $400 fee applies after Week 1 up to 50% of the program. No deferrals for Specialty Programs.
- Specialty Access: One-year access starting February 2, 2026, or date of enrollment—whichever is later. No extensions.
- Re-Enrollment: INCCP students past 50% may re-enroll with a one-time 25% discount. Specialty students must re-enroll at current tuition if access expires.

Full Course Policies, Terms & Conditions
By registering for any Integrative Nurse Coach® Academy (“INCA”) course, program, event, or product, you agree to the following policies and terms.
Summary of Policies
Respectful Conduct
You agree to be respectful toward fellow students, faculty, and INCA staff within the course environment and in all public domains.
- INCA may remove any learner whose conduct is harassing, harmful, obscene, incendiary, threatening, or defamatory (“Inappropriate Conduct”), including on social media or in public settings.
- Removal for Inappropriate Conduct may occur without warning and no refund will be provided. You may also be prohibited from enrolling in future programs.
Intellectual Property
You agree not to share, distribute, reproduce, re-purpose, or otherwise use INCA’s intellectual property or course materials outside the course without written permission from an INCA Executive.
- Program materials (slides, handouts, forms, videos, etc.) are proprietary and owned by INCA.
- Some materials are explicitly marked for use with clients; these must be used without alteration and must retain copyright information.
- If the material does not explicitly state it may be used outside the course, you may not use it.
- You may not allow anyone else to access INCA’s online learning environment using your login or to participate in the course alongside you.
Payment Plan Responsibility
If you enroll using a payment plan:
- You are responsible for keeping your payment method up to date.
- Payments are automatically billed to the payment source provided at checkout until the balance is paid in full.
- Late or failed payments may result in suspension or removal from the course under the Removal Policy.
- Certificates of completion will not be issued until tuition is paid in full.
Refund Policy
Courses, Programs, Events, and Products Under $100
- Not refundable at any point, with no exceptions.
Integrative Nurse Coach® Certificate Program (INCCP – All Levels)
Refunds are available only when all of the following are true:
- Your course start date is 30 or more days from the date of registration, and
- You request a refund within 0–48 hours of registering, and
- You have not submitted any pre-course surveys and have not accessed any course materials.
To request:
- Email support@inursecoach.com within 48 hours of payment.
Additional terms:
- If you registered using a payment plan, the payment plan administrative fee is non-refundable.
- If your course begins in 29 or fewer days, no refund is issued.
- After 48 hours from registration, no refund is issued regardless of start date.
- Once any pre-course survey has been submitted or materials accessed, you are no longer eligible for a refund.
- If you are not eligible for a refund, you may be eligible to defer or re-enroll under the INCCP Deferral Policy and Re-Enrollment Policy (below).
- Deferral does not cancel or pause any payment plan; all payments continue as scheduled.
Specialty Programs (All Other Programs – On-Demand)
These policies apply to all Specialty Programs (non-INCCP) priced at $100 or more.
- You may request a refund in writing to support@inursecoach.com within 1 business day of registering.
- However, once you have accepted the course invitation or accessed any course materials, you are no longer eligible for a refund, even if less than 1 business day has passed.
- Deferrals do not apply to Specialty Programs.
- Payment plan admin fees remain non-refundable.
Processing Fees (All Courses)
- All approved refunds will have a minimum 6% processing fee deducted to cover transaction and administrative costs.
- Payment plan administrative fees are never refundable.
Deferral Policy (INCCP Only)
No deferrals or extensions are available for Specialty Programs.
The deferral policy applies only to the Integrative Nurse Coach® Certificate Program (INCCP).
How to Request a Deferral
- All deferral requests must be submitted via the Deferral Form located in the Canvas Support menu.
- Emails to instructors, faculty mentors, supervisors, admissions, or INCA staff do not constitute a valid deferral request and will not be processed.
- Deferrals are only available if a future offering of the program is available. If no future cohort is scheduled, contact support@inursecoach.com to discuss options.
Deferral Request Before or During Week 1 (First 7 Days)
- Students may request a one-time complimentary deferral to the next offering of the program (if available).
- To access the complimentary deferral, students must speak with their faculty mentor to initiate a deferral fee waiver code.
- The waiver is valid only if:
- It is the student’s first deferral, and
- The request is submitted in writing via the Deferral Form by 11:59 PM ET on the Sunday of Week 1.
- No exceptions will be granted after this deadline.
Deferral Request After Week 1 but Before the Halfway Mark
- Deferral requests incur a $400 deferral fee, payable at the time the Deferral Form is submitted
- The fee must be paid in full before the request is processed
Payment Terms for Deferrals
- Any applicable deferral fee is due when the form is submitted.
- Payment plans continue under the original terms and are not paused, delayed, or deferred.
Limits and Time Windows
- Students may defer only one time; no second deferrals are permitted, even with a fee.
- Students may only defer to the next available offering that begins within one year of their original program start date.
- If no future offering of the course is available, students should contact support@inursecoach.com to discuss options.
Re-Enrollment Policy
INCCP – After 50% Mark or If an Additional Deferral Is Requested
- Deferral requests submitted after the 50% mark of the program, or any request for a second deferral, will not be honored.
- Instead, students may re-enroll in a future offering of the course (if available) using a one-time 25% off re-enrollment discount code.
- Students must request the code by emailing support@inursecoach.com before re-enrolling.
- The discount code is:
- Valid for one year from the original program’s start date
- One-time use only
- Not combinable with other INCA discounts or scholarships
- If no future offering of the course is available, students should contact support@inursecoach.com to discuss options.
Specialty Programs – After Access Expires
- Specialty Programs provide one year of access starting February 2, 2026, or from the date of enrollment, whichever is later
- No extensions are available under any circumstance
- If the access period expires, no certificate will be issued
- To take the program again, learners must re-enroll at the current tuition rate
- Re-enrollment discounts are not guaranteed but may be available at INCA’s discretion. Contact support@inursecoach.com for more details
Completion Policy
To receive a certificate of completion, contact hours, or a letter of completion, students must:
- Have paid tuition in full for the program (including all payment plan installments), and
- Participate in and complete all course requirements as outlined in the syllabus or course portal.
INCCP
- If a student does not complete the program requirements within 30 days of the scheduled end date, they may re-enroll in a future offering using a one-time, non-transferable 25% off discount code by emailing support@inursecoach.com.
Specialty Programs
- Program access ends one year after the access start date (February 2, 2026, or the date of enrollment, whichever is later)
- No extensions are offered
- If requirements are not completed within the access period, no certificate will be issued
Financial Policies (General)
Tuition and Payment Plans
- Tuition is due at the time of enrollment.
- If you choose a payment plan, a one-time administrative fee may be added to your first payment.
- Payments are automatically billed to the payment source provided at checkout until the balance is paid in full.
- Failure to make timely payments may result in:
- Suspension from the course
- Removal under the Removal Policy
- Ineligibility to re-enroll in future programs
Payment Plan Cancellation
- If you defe, your payment plan continues as originally scheduled—it is not paused or canceled.
- No refunds are provided on payment plans at any time.
Cancellation by INCA
- INCA reserves the right to cancel any course or change program start dates.
- In the event of cancellation by INCA, you may choose either:
- A full refund of registration fees paid, or
- Credit toward an alternative course or offering.
Technology
Technical Requirements
You are responsible for ensuring that you have compatible computers, equipment, and software to view and access the course. Technical requirements are published on our website.
System Downtime
INCA does not guarantee that online content will always be available, uninterrupted, timely, or error-free.
- Scheduled system maintenance may occur; INCA will provide at least 72 hours’ notice when possible.
- INCA will respond promptly to program situations to address concerns.
Ownership, Intellectual Property, and Course Sharing
Ownership, Intellectual Property, and Course Sharing
You are granted a revocable, non-exclusive, non-transferable license to access and use INCA course materials solely for your personal participation in the course.
Course materials include, but are not limited to: videos, slides, handouts, forms, worksheets, audio files, transcripts, downloads, and any related educational content.
Prohibited Uses
You may not, under any circumstance:
- Share, distribute, or provide access to course materials or your login credentials to any third party
- Copy, reproduce, modify, lend, sell, publish, upload, or otherwise distribute any course materials
- Use course materials in any trainings, courses, workshops, clinical education, products, or services—paid or unpaid—without prior written permission from an INCA Executive
Materials explicitly marked as approved for client use must:
- Be used without alteration, and
- Retain all copyright and attribution information
All other materials may not be used outside the course for any purpose.
Enforcement
Any unauthorized use constitutes an infringement of INCA’s intellectual property rights.
If INCA detects or becomes aware of prohibited use at any time:
- The learner is subject to the Removal Policy,
- No refund will be issued, and
- INCA reserves the right to pursue compensation for damages, including lost revenue and associated legal remedies.
INCA may revoke access to course materials at its sole discretion.
Inappropriate Conduct and Removal Policy
Inappropriate Conduct
INCA may remove any student whose behavior is deemed Inappropriate Conduct, including (but not limited to) harassing, harmful, obscene, incendiary, threatening, or defamatory comments or actions in any course space or public forum.
Removal Policy
INCA may remove you from the course if you:
- Fail to make payments as scheduled
- Violate these Terms or Intellectual Property provisions
- Engage in Inappropriate Conduct or share other learners’ personal information
If removed:
- You are not eligible for a refund
- You remain responsible for any outstanding tuition
- You may be ineligible to participate in future courses
INCA reserves the right to remove you without warning.
Non-Competition
You agree that, during your participation in any INCA course and for two (2) years thereafter, you will not:
- Work for, become employed by, own as a shareholder/partner/member/joint venturer, or otherwise participate in any organization in the United States that:
- Competes with INCA, and/or
- Has a primary or secondary purpose of educating, training, teaching, or providing instruction to nurse coaches.
You agree these limitations are reasonable and necessary to protect INCA’s interests and that INCA would not have entered into these Terms without them. These non-compete provisions, and those relating to Intellectual Property, survive termination of these Terms.
Modifications
INCA may update these Terms at any time without prior notice and may impose new or additional terms related to your enrollment and use of materials.
- Modifications become effective immediately when posted or shared with you.
- Your continued use of or access to the course or INCA educational resources constitutes acceptance of any changes.
- You are responsible for reviewing these Terms regularly.
Enforceability
This agreement is governed by the laws and statutes of the State of Florida.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed and reformed to the maximum extent permitted by law, and the remainder will continue in full force and effect.
Limitation of Liability
To the fullest extent permitted by law, INCA, its parent companies, subsidiaries, and affiliates are not liable for:
- Any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the website, courses, products, or services, or any third-party materials made available by INCA, even if INCA has been advised of the possibility of such damages.
- Any defamatory, offensive, or illegal conduct of any user.
Your sole remedy if you are dissatisfied with the site, course, products, services, or these Terms is to discontinue use.
INCA is not an investment advisory service, financial advisor, or provider of legal or tax advice and does not provide medical advice. All information is for educational and general informational purposes only and should not be relied upon as investment, tax, accounting, medical, or legal advice. You are responsible for consulting appropriate professionals before acting on any information provided by INCA.
You must never rely on course information as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a physician or qualified health provider with any questions regarding a medical condition and never delay seeking professional advice because of something read in INCA materials.
Our Guarantee to You
Student satisfaction and program quality are a priority. INCA regularly evaluates program content and delivery through surveys and course evaluations. Feedback is reviewed and used to continually improve course content and learner experience.
By registering for any INCA course, program, event, or product, you agree to all terms and conditions contained in the policies above.

You understand that if you do not complete the program requirements, or do not complete your payment plan (if applicable) by the end of the program, you will not receive a certificate of completion. By enrolling in any of the Integrative Nurse Coach® Academy (“INCA”) courses, you are agreeing to the following terms and conditions. Terms must be agreed to prior to enrolling in our courses.
Successful Course Completion Policy
Attendance and Participation Policy
Successful students will plan to access the course on a regular basis to ensure appropriate participation in course activities and to meet assignment timelines. Courses may contain video lectures, textbook readings, discussion forum groups, quizzes, reflective activities, written assignments, peer practice, peer coaching, client coaching, and/or awareness practice requirements.
To receive a certificate, contact hour award, and/or letter of completion, students must:
- Have paid tuition in full for the program and have no outstanding payments due (if on a payment plan).
- Participate in and complete all course requirements.
If a student does not complete the program requirements within 30 days of the scheduled end date, the student may re-enroll in the program using a one-time, non-transferable 25% off discount code. The student must email support@inursecoach.com to obtain this discount code.

If you fail to make a timely tuition payment, for any reason, you may be suspended from the Course and will be subject to the Removal Policy (explained below). Late payments may incur late fees and subject you to immediate removal from the Course, with no ability to re-enroll.
Refund Policy
Subscriptions, Introductory Courses, and Courses under $100 are non-refundable, with no exceptions.
All Other Courses:
Request for Refund when the course begins in 30 or more days
- Within 0–48 hours of registering for the course
- You may cancel and receive a 97% refund within 48 hours of registering for a course. Exception: if you registered using a payment plan, the payment plan admin fee is always non-refundable.
- Request must be made in writing to support@inursecoach.com.
- No refund will be granted if any pre-course surveys have been submitted by the participant within the first 48 hours of registering.
- 48 or more hours after registering for the course
- No refund will be issued. You may defer under the Deferral Policy (below), if available.
- Deferral does not void remaining payment plan payments; all payments must continue as scheduled (see Payment Plan Cancellation below).
- Follow the Deferral Policy process; emails alone do not constitute a deferral request.
Course begins in 29 or fewer days
- No refund will be issued.
- You may defer under the Deferral Policy (below), if available. Cancellation does not void remaining payment plan payments; all payments must continue as scheduled.
After the course has begun
- No refund will be issued.
- You may submit a deferral request pursuant to the Deferral Policy (below). Complimentary deferral is only available if it is your first deferral and the waiver is requested by 11:59 PM ET on the Sunday of Week 1.
Deferral Policy
- How to Request: All deferral requests must be submitted by completing the Deferral Form located in the Canvas Support menu. Emails to instructors, supervisors, admissions, or INCA staff do not constitute a valid deferral request and will not be processed.
- Eligibility of Offerings: The Deferral Policy applies only if there is another offering of the course available. If no future offering exists, contact support@inursecoach.com to discuss options.
- Timing & Fee (Before or During Week 1):
- Students may request a one-time, complimentary deferral to the next offering (if available) by obtaining a deferral fee waiver code from support@inursecoach.com.
- The waiver is valid only if:
- It is the student’s first deferral, and
- The request is submitted by 11:59 PM ET on the Sunday of the first week of the course. No exceptions.
- Timing & Fee (Week 2 up to 50% of the program):
- Deferral requests submitted from Week 2 up to the 50% mark of the program incur a deferral fee, payable at the time the Deferral Form is submitted:
- Tuition ≤ $700: $150
- Tuition > $700: $400
- After 50% of the Program: Deferral requests submitted after the 50% mark will not be honored (see Re-Enrollment Policy below).
- Limits & Windows:
- Students may defer only one time. No second deferrals are permitted, even with a fee.
- If another cohort is available, students may only defer to the next available offering that begins within one year of their original program start date.
- Payment plans continue under the original terms and are not paused, delayed, or deferred.
Re-Enrollment Policy (After 50% Mark or if a Second Deferral is Sought)
- If you are past the 50% mark of the program, or if you request a second deferral, a deferral will not be granted.
- Instead, you may re-enroll in a future offering of the course (if available) using a one-time 25% off re-enrollment discount code.
- Request the code by emailing support@inursecoach.com before re-enrolling.
- The code is one-time use, valid for one year from the original program start date, and not combinable with other INCA discounts or scholarships.
- If no future offering exists, contact support@inursecoach.com to discuss options.
Payment Plan Cancellation
If you opt for a payment plan and defer or re-enroll at any time, your payment plan will still proceed as scheduled. No refunds are permitted for payment plans at any time.
Cancellation by the Integrative Nurse Coach® Academy
INCA reserves the right to cancel any course or change program start dates. In the event of cancellation by INCA, you may elect to receive a full refund of registration fees paid or credit toward alternative class(es).
Technology

You understand and acknowledge that you are responsible for ensuring that you have compatible computer(s), equipment, and software necessary for you to view and access the course. The technical requirements are published on our website.
System Downtime
INCA does not warrant that the provision of any content online will always be available or be uninterrupted, timely, or error free. However, INCA will quickly respond to program situations to address the concerns. There may be scheduled periods of system downtime for system maintenance, which you will be notified of at least 72 hours in advance.
Ownership, Intellectual Property, Course Sharing
You are granted a revocable, non-exclusive, non-transferable license to use the Course Materials for the sole purpose of advancing your understanding of the Course. You may not share the materials with any third party or use the Materials in any other way.
You acknowledge that all of the materials, concepts, techniques, presentations, audio, methods, curricula, and other information (collectively, the “Materials”) you are exposed to or provided with in connection with the Course are the sole and exclusive property of INCA. Materials are considered intellectual property and are owned by INCA.
Permission is granted for use of certain program materials by students and graduates for patient care coaching and must be used without alteration and contain the copyright information. These materials will be marked in the course. Permission is required for any other use. Any such use without permission is strictly prohibited and will constitute an infringement of INCA’s intellectual property rights. If the course material does not explicitly state it can be used by the student/graduate outside of the course, it may not be used.
You may not allow anyone else to access the e-training courses via your log-in details, or view or participate in the online learning along with you.
You agree not to reproduce, copy, or otherwise duplicate, distribute, lend, sell, or otherwise transfer or disclose to any individual, business, or other party, any of the Materials without the prior written consent of INCA.
Inappropriate Conduct
INCA reserves the right to remove any student (per the removal policy below) from a course should the student’s behavior be deemed inappropriate. Inappropriate conduct is or may be considered harassing, harmful, obscene, incendiary, threatening, or defamatory (singularly or collectively, “Inappropriate Conduct”), regardless of its intended target. This applies within the course, as well as on any social media outlet or public setting.
Whether or not the student’s conduct constitutes Inappropriate Conduct will be determined in INCA’s sole and exclusive judgment.
INCA will not refund fees or tuition nor reimburse any other costs should this occur, and you may be prohibited from enrolling in future programs.
Removal Policy
INCA reserves the right to remove you from the Course if you fail to make payments as scheduled or violate these Terms. If you are removed from the Course, you may be subject to charges, including the remaining tuition payments owed. Removal may mean you’re not eligible to enroll in future Courses. You may also be suspended or removed at any time for inappropriate comments or disclosure of other learners’ personal information. INCA reserves the right to remove you without warning.
Any student who is removed from the course for any of the above reasons will not be eligible for a refund of any kind, is required to pay any outstanding tuition, and may not be eligible to participate in future courses.
Non-Competition
You agree that, during your participation in the Course and for a period of two (2) years thereafter, you will not work for, become employed by, own as a shareholder, partner, member, joint venture or otherwise, and/or otherwise participate in any organization in the United States that: (i) competes with INCA and/or (ii) the primary or secondary purpose of which is to educate, train, teach, and/or otherwise provide instruction to nurse coaches. You agree that this limitation is reasonable in light of the Course you have received and/or are slated to receive. You also acknowledge and agree that the foregoing restrictions (and those set forth in “Intellectual Property”) are necessary to protect INCA’s interests and that INCA would not have entered into these Terms in the absence of such restrictions. The terms of this “Non-Compete” shall survive termination of these Terms.
Modifications
INCA reserves the right, at any time and without prior notice, to modify these Terms and to impose new or additional terms or conditions relating to your enrollment and use of the Materials. Modifications and additional terms and conditions will be effective immediately and incorporated into these Terms, which will be shared with you. Your continued use of, or access to the Course, and/or other INCA educational resources, online portals, repositories, and/or systems will be deemed an acceptance of these Terms and any subsequent changes. You are responsible for regularly checking these Terms for changes.
Enforceability
This agreement is enforceable per the laws and statutes in the state of Florida. In the event that any term, provision, covenant, or condition of these Terms is found to be invalid, illegal, or otherwise unenforceable, such unenforceable provision shall be severed, the remainder of these Terms shall continue in full force and effect, and such provision will be reformed to provide the maximum protection to INCA permissible under law.
Limitation of Liability
Under No Circumstances, Including, But Not Limited To, Negligence, Shall the Integrative Nurse Coach® Academy, LLC, Subsidiaries And Parent Companies Or Affiliates Be Liable For Any Direct, Indirect, Incidental, Special Or Consequential Damages That Result From The Use Of, Or The Inability To Use, The Site, Including Our Messaging, Blogs, Comments Of Others, Books, Emails, Products, Or Services, Or Third-Party Materials, Products, Or Services Made Available Through The Site Or By INCA In Any Way, Even If INCA Is Advised Beforehand Of The Possibility Of Such Damages. (Because Some States Do Not Allow the Exclusion Or Limitation Of Certain Categories Of Damages, The Above Limitation May Not Apply To You. In Such States, Our Liability and The Liability of Our Subsidiary and Parent Companies or Affiliates Is Limited to The Fullest Extent Permitted by Such State Law.)

By enrolling in any of the Integrative Nurse Coach® Academy (“INCA”) courses, you are agreeing to the following terms and conditions. Terms must be agreed to prior to enrolling in our courses.
Successful Course Completion Policy
Attendance and Participation Policy
Successful students will plan to access the course on a regular basis to ensure appropriate participation in course activities and to meet assignment timelines. Courses may contain video lectures, textbook readings, discussion forum groups, quizzes, reflective activities, written assignments, peer practice, peer coaching, client coaching, and/or awareness practice requirements.
To receive a certificate, contact hour award, and/or letter of completion, students must:
- Have paid tuition in full for the program and have no outstanding payments due (if on a payment plan).
- Participate in and complete all course requirements.
If a student does not complete the program requirements within 30 days of the scheduled end date, the student may re-enroll in the program using a one-time, non-transferable 25% off discount code. The student must email support@inursecoach.com to obtain this discount code.
Financial Policies
Tuition and Payment Plans
Tuition is due at the time of enrollment. If you opt for a payment plan, you may be subject to a one-time administrative fee added to your first payment. Payments will be automatically billed to the payment source provided at checkout until the balance has been paid in full.
If you fail to make a timely tuition payment, for any reason, you may be suspended from the Course and will be subject to the Removal Policy (explained below). Late payments may incur late fees and subject you to immediate removal from the Course, with no ability to re-enroll.
Refund Policy
Subscriptions, Introductory Courses, and Courses under $100 are non-refundable, with no exceptions.
All Other Courses:
Request for Refund when the course begins in 30 or more days
- Within 0–48 hours of registering for the course
- You may cancel and receive a 97% refund within 48 hours of registering for a course. Exception: if you registered using a payment plan, the payment plan admin fee is always non-refundable.
- Request must be made in writing to support@inursecoach.com.
- No refund will be granted if any pre-course surveys have been submitted by the participant within the first 48 hours of registering.
- 48 or more hours after registering for the course
- No refund will be issued. You may defer under the Deferral Policy (below), if available.
- Deferral does not void remaining payment plan payments; all payments must continue as scheduled (see Payment Plan Cancellation below).

- If another cohort is available, students may only defer to the next available offering that begins within one year of their original program start date.

- If you are past the 50% mark of the program, or if you request a second deferral, a deferral will not be granted.

- The code is one-time use, valid for one year from the original program start date, and not combinable with other INCA discounts or scholarships.

Payment Plan Cancellation
If you opt for a payment plan and defer or re-enroll at any time, your payment plan will still proceed as scheduled. No refunds are permitted for payment plans at any time.
Cancellation by the Integrative Nurse Coach® Academy
INCA reserves the right to cancel any course or change program start dates. In the event of cancellation by INCA, you may elect to receive a full refund of registration fees paid or credit toward alternative class(es).
Technology
Technical Requirements
You understand and acknowledge that you are responsible for ensuring that you have compatible computer(s), equipment, and software necessary for you to view and access the course. The technical requirements are published on our website.
System Downtime
INCA does not warrant that the provision of any content online will always be available or be uninterrupted, timely, or error free. However, INCA will quickly respond to program situations to address the concerns. There may be scheduled periods of system downtime for system maintenance, which you will be notified of at least 72 hours in advance.
Ownership, Intellectual Property, Course Sharing
You are granted a revocable, non-exclusive, non-transferable license to use the Course Materials for the sole purpose of advancing your understanding of the Course. You may not share the materials with any third party or use the Materials in any other way.
You acknowledge that all of the materials, concepts, techniques, presentations, audio, methods, curricula, and other information (collectively, the “Materials”) you are exposed to or provided with in connection with the Course are the sole and exclusive property of INCA. Materials are considered intellectual property and are owned by INCA.
Permission is granted for use of certain program materials by students and graduates for patient care coaching and must be used without alteration and contain the copyright information. These materials will be marked in the course. Permission is required for any other use. Any such use without permission is strictly prohibited and will constitute an infringement of INCA’s intellectual property rights. If the course material does not explicitly state it can be used by the student/graduate outside of the course, it may not be used.
You may not allow anyone else to access the e-training courses via your log-in details, or view or participate in the online learning along with you.
You agree not to reproduce, copy, or otherwise duplicate, distribute, lend, sell, or otherwise transfer or disclose to any individual, business, or other party, any of the Materials without the prior written consent of INCA.
Inappropriate Conduct
INCA reserves the right to remove any student (per the removal policy below) from a course should the student’s behavior be deemed inappropriate. Inappropriate conduct is or may be considered harassing, harmful, obscene, incendiary, threatening, or defamatory (singularly or collectively, “Inappropriate Conduct”), regardless of its intended target. This applies within the course, as well as on any social media outlet or public setting.
Whether or not the student’s conduct constitutes Inappropriate Conduct will be determined in INCA’s sole and exclusive judgment.
INCA will not refund fees or tuition nor reimburse any other costs should this occur, and you may be prohibited from enrolling in future programs.
Removal Policy
INCA reserves the right to remove you from the Course if you fail to make payments as scheduled or violate these Terms. If you are removed from the Course, you may be subject to charges, including the remaining tuition payments owed. Removal may mean you’re not eligible to enroll in future Courses. You may also be suspended or removed at any time for inappropriate comments or disclosure of other learners’ personal information. INCA reserves the right to remove you without warning.
Any student who is removed from the course for any of the above reasons will not be eligible for a refund of any kind, is required to pay any outstanding tuition, and may not be eligible to participate in future courses.
Non-Competition
You agree that, during your participation in the Course and for a period of two (2) years thereafter, you will not work for, become employed by, own as a shareholder, partner, member, joint venture or otherwise, and/or otherwise participate in any organization in the United States that: (i) competes with INCA and/or (ii) the primary or secondary purpose of which is to educate, train, teach, and/or otherwise provide instruction to nurse coaches. You agree that this limitation is reasonable in light of the Course you have received and/or are slated to receive. You also acknowledge and agree that the foregoing restrictions (and those set forth in “Intellectual Property”) are necessary to protect INCA’s interests and that INCA would not have entered into these Terms in the absence of such restrictions. The terms of this “Non-Compete” shall survive termination of these Terms.
Modifications
INCA reserves the right, at any time and without prior notice, to modify these Terms and to impose new or additional terms or conditions relating to your enrollment and use of the Materials. Modifications and additional terms and conditions will be effective immediately and incorporated into these Terms, which will be shared with you. Your continued use of, or access to the Course, and/or other INCA educational resources, online portals, repositories, and/or systems will be deemed an acceptance of these Terms and any subsequent changes. You are responsible for regularly checking these Terms for changes.
Enforceability
This agreement is enforceable per the laws and statutes in the state of Florida. In the event that any term, provision, covenant, or condition of these Terms is found to be invalid, illegal, or otherwise unenforceable, such unenforceable provision shall be severed, the remainder of these Terms shall continue in full force and effect, and such provision will be reformed to provide the maximum protection to INCA permissible under law.
Limitation of Liability
Under No Circumstances, Including, But Not Limited To, Negligence, Shall the Integrative Nurse Coach® Academy, LLC, Subsidiaries And Parent Companies Or Affiliates Be Liable For Any Direct, Indirect, Incidental, Special Or Consequential Damages That Result From The Use Of, Or The Inability To Use, The Site, Including Our Messaging, Blogs, Comments Of Others, Books, Emails, Products, Or Services, Or Third-Party Materials, Products, Or Services Made Available Through The Site Or By INCA In Any Way, Even If INCA Is Advised Beforehand Of The Possibility Of Such Damages.
